Terms of Service

1. Acceptance of Terms
By accessing or using Riffboard ("the Service"), operated by Evans Consulting, registered with the Dutch Chamber of Commerce (KVK) under number 69763143 ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and Evans Consulting. They are governed by Dutch law, as described in Section 14.
2. Description of Service
Riffboard is a web-based management platform for independent musicians, bands, and small labels. The Service provides tools for managing releases, catalogue metadata, contacts, fans, venues, tasks, projects, calendar events, electronic press kits (EPKs), smart links, link-in-bio pages, streaming metrics, and other aspects of music career management.
The Service is currently in a closed beta phase. Features, pricing, and availability may change as the platform develops.
3. Account Registration
You must sign in using a Google account or via email magic link to use the Service. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to update it as necessary.
During the closed beta period, access is limited to users whose email addresses have been approved. We reserve the right to grant or revoke access at our discretion.
You may not create an account on behalf of another person without their express permission. You may not share your account credentials or allow others to access the Service through your account.
4. User Content and Intellectual Property
You retain all ownership rights to content you upload or create on the Service, including but not limited to: artist profiles, release metadata, recordings metadata, contact information, fan data, venue details, task descriptions, EPK content, and uploaded images ("User Content").
By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your User Content solely for the purpose of providing the Service to you. This licence ends when you delete your content or your account.
Where you make content publicly available (e.g., via EPK pages, smart links, or Linkboard pages), you grant us the right to display that content to the public as directed by you.
We do not claim any ownership over your User Content. The Riffboard name, logo, and platform design are the intellectual property of Evans Consulting.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious code, viruses, or content designed to disrupt the Service
- Attempt to gain unauthorised access to other users' accounts or data
- Use the Service to store or distribute content that infringes third party intellectual property rights
- Resell, redistribute, or commercially exploit the Service without permission
- Use automated tools (bots, scrapers) to access the Service without our written consent
- Interfere with or circumvent the security or access controls of the Service
We reserve the right to suspend or terminate your account if you violate these terms.
6. Privacy and Data Protection
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
We process personal data in compliance with the General Data Protection Regulation (GDPR) and the Dutch implementation thereof (Uitvoeringswet AVG). Your data rights are described in our Privacy Policy.
7. Data Portability and Export
You may export your data at any time using the Data Export feature in your account settings. Available export formats include CSV and JSON.
Upon termination of your account, you will have 30 days to export your data before it is permanently deleted. If you need assistance with data export, please contact us at hello@riffboard.com.
8. Data Storage and Security
We use industry-standard security measures to protect your data, including encrypted connections, row-level security, and role-based access control. Data is stored using Supabase (PostgreSQL, EU region) and file storage services. For full details, see our Privacy Policy.
While we strive to protect your data, no method of electronic storage is completely secure, and we cannot guarantee absolute security.
9. Service Availability
We aim to provide reliable access to the Service but do not guarantee uninterrupted availability. The Service is provided on an "as is" and "as available" basis, particularly during the beta period.
We may perform maintenance, updates, or modifications that temporarily affect availability. Where possible, we will provide advance notice of planned downtime.
10. Pricing and Payment
During the closed beta period, the Service is provided free of charge. We intend to introduce paid plans in the future.
When paid plans are introduced, we will notify existing users at least 30 days in advance. You will not be charged without your explicit consent. Details of pricing, billing cycles, and payment methods will be communicated before any charges apply.
In accordance with Dutch and EU consumer protection law, you will have a 14-day right of withdrawal (herroepingsrecht) from the date of purchasing a paid plan, unless you have already begun using paid features and have waived this right.
11. Termination
You may stop using the Service and request deletion of your account at any time by contacting us at hello@riffboard.com.
We may suspend or terminate your access to the Service if you materially breach these Terms, engage in prohibited conduct, or if we are required to do so by law. Where reasonably possible, we will provide notice and an explanation before termination.
Upon termination, you will have 30 days to export your data using the Data Export feature or by contacting us. After this period, your data will be permanently deleted in accordance with our Privacy Policy.
12. Limitation of Liability
To the extent permitted by Dutch and EU law:
- We shall not be liable for indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
- Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim (or €100 if the Service was free).
Nothing in these Terms excludes or limits our liability for fraud, wilful misconduct (opzet), gross negligence (grove schuld), death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under Dutch or EU law.
Your statutory rights as a consumer under Dutch and EU law are not affected by these Terms.
13. Changes to Terms
We reserve the right to modify these Terms from time to time. For material changes, we will notify you via email or through a notice in the Service at least 14 days before the changes take effect.
If you do not agree with the updated Terms, you may stop using the Service and request deletion of your account before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Netherlands.
Any disputes arising from or in connection with these Terms or the Service shall be submitted to the competent court in Haarlem (Rechtbank Noord-Holland), the Netherlands. However, if you are a consumer within the meaning of EU law, you retain the right to bring proceedings in the courts of your place of residence.
Before initiating legal proceedings, we encourage you to contact us to resolve any dispute informally. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
